| Abstract: | ويتضح من خلال القانون رقم 23 / 12 ، الذي يحدد القواعد العامة المتعلقة بالمشتريات العامة ، أن المشرع الجزا ئري فرض عدة آليات رقابية.وهي تتألف من الرقابة الداخلية ، ممثلة بلجنتي فتح العطاءات والتقييم داخل السلطة المتعاقدة. بالإضافة إلى ذلك ، هناك رقابة خارجية سابقة تمارسها لجان المشتريات العامة )المجلس الوطني للمشتريات العامة ، واللجان القطاعية( علاوة على ذلك ، تخضع المشتريات العامة للرقابة اللاحقة ، والتي تشمل الإشرا فعلىالوصاية )الإشرا ف الإداري( ، وكذلك الإشرا ف من قبل ديوان مرا جعي الحسابات والمفتشية المالية العامة. وتهدف هذه الآليات إلى ترسيخ مبادئ الشفافية والنزا هة بين الفاعلين الاقتصاديين وحماية الأموال العامة من جميع أشكال الفساد |
| Description: | It is evident through Law No. 23/12, which defines the general rules related to public procurement, that the Algerian legislator has imposed several oversight mechanisms.These consist of internal oversight, represented by the Bid Opening and Evaluation Committees within the contracting authority. Additionally, there is prior external oversight exercised by Public Procurement Commissions (The National Public Procurement Council, and Sectoral Commissions(Furthermore, public procurement is subject to subsequent oversight, which includes guardianship oversight (administrative supervision), as well as oversight by the Court of Auditors and the General Finance Inspectorate. These mechanisms aim to consolidate the principles of transparency and integrity among economic operators and to protect public funds from all forms of corruption. |
