| Abstract: | تتمحور هذه الد را سة حول مكافحة عصابات الأحياء في ظل الأمر 02 الموضوع انطلاقا من الإشكالية التالية : كيف واجه المشرع الجزا ئري تداعيات خطر عصابات الأحياء في ظل هذه المقاربات الوقائية الردعية ؟. تهدف هذه الد را سة لتسليط الضوء على جريمة عصابات الأحياء من خلال معرفة طبيعتها القانونية وتميزها عن بعض الجرا ئم المشابهة لها على غرا ر جريمة تكوين جمعية أشرا ر و الجريمة المنظمة الوطنية ، والجريمة المنظمة عبر الوطنية ، و جرا ئم المنظمات الإرهابية ،هذا وترتكز جرا ئم عصابات الأحياء على الأركان العامة للجريمة والمتمثلة في الركن الشرعي ، والمادي والمعنوي ، وفي سبيل محاولة الإحاطة بالأسباب التي أدت إلى انتشارها تم التطرق إلى بعض العوامل الداخلية كالورا ثة و السلالة والسن و الإدمان فيماأسندنا العوامل الخارجية إلى عوامل طبيعية وأخرى اجتماعية وكذا بعض العوامل الاقتصادية ، وتبعا لهذه الأسباب استحدث المشرع الجزا ئري آليات وقائية تتمثل في اللجان الوطنية والولائية للوقاية من عصابات الأحياء و إجرا ءات ردعية تتمثل في عقوبات جزا ئية تشمل الشخص 10 حيث عالجنا - 20 الملحق بالقانون 02 - الطبيعي وكذا الشخص المعنوي وهذا وفقا للأمر 02 هذا الموضوع استنادا إلى مجموعة من المناهج المعتمدة كالمنهج الوصفي ، المقارن ، والتحليلي الذي غلب على الد را سة لحصر نطاقها في نصوص قانونية لننتهي إلى مجموعة من النتائج من أبرزها أن مهمة مكافحة عصابات الأحياء غير موقوفة على سلطات الدولة فحسب بل تتعدى خطورة الموقف إلى إشرا ك المجتمع المدني ومختلف الأطرا ف الفاعلة للحد من خطورة هذا النوع من الجرا ئم وتجدر الإشارة إلى ضرورة تلافي المشرع الجزا ئري لبعض النقائص في فحوى نصوص 10 بعدم إشارته إلى بعض الفئات الهشة في المجتمع . - ومواد القانون |
| Description: | This study focuses on fighting neighborhood gangs under Law 20-30. We approach this topic by addressing the following question: How has the Algerian legislature addressed the repercussions of the threat posed by neighborhood gangs through these preventive and deterrent measures? This study aims to shed light on the crime of neighborhood gangs by examining its legal nature and distinguishing it from similar crimes, such as the crime of forming a criminal association, national organized crime, transnational organized crime, and crimes committed by terrorist organizations. Neighborhood gang crimes are based on the general elements of a crime, namely the legal, material, and moral elements. In an effort to understand the causes of their spread, we have addressed certain internal factors such as heredity, lineage, age, and addiction, while attributing external factors to natural, social, and economic causes. Based on these causes, the Algerian legislature has stablished preventive mechanisms in the form of national and provincial committees for the prevention of neighborhood gangs, as well as deterrent measures consisting of criminal penalties applicable to both natural and legal persons, in accordance with Decree 20 -03 annexed to Law 20-10. We addressed this topic based on a set of adopted methodologies, such as the descriptive, comparative, and analytical approaches, which dominated the study to limit its scope to legal texts. We arrived at a set of findings, the most notable of which is that the task of combating neighborhood gangs does not rest solely with state authorities; rather, given the gravity of the situation, it requires the involvement of civil society and various stakeholders to mitigate the danger of this type of crime. It is worth noting the need for the Algerian legislature to address certain shortcomings in the content of the provisions of Law 20-10, as it fails to mention certain categories |
