| Description: | This subject addresses the legal and Sharia provisions governing real estate bequests (wills) issued during a "terminal illness" (Marad al-Mawt). It begins by defining the linguistic, idiomatic, and legal concepts that integrate Family Law and Civil Law, focusing on the nature of terminal illness, its verification criteria, and methods of proof, given its fundamental impact on the validity of legal actions.Such a bequest is built upon essential pillars: the testator (Al-Musi), the beneficiary (Al-Musa lahu), the bequeathed property (Al-Musa bihi), and the legal form (Sigha). It is categorized into five types: obligatory, recommended, prohibited, disliked, and encouraged; the failure of any pillar or the emergence of legal impediments leads to its nullity.Furthermore, real estate bequests are subject to strict regulations aimed at balancing the testator's will with the protection of heirs' rights—most notably, adhering to the "one-third" limit of the estate and ensuring the testator's will is free from coercion. This study highlights specific complexities in the real estate sector regarding the difficulty of proving the state of terminal illness and the legal challenges of transferring ownership. These issues often lead to legal disputes requiring judicial intervention to be resolved in accordance with the principles of Islamic Sharia and applicable statutory laws. |
