dc.descriptionThis subject addresses the legal and Sharia provisions governing real estate bequests (wills) issued during a "terminal illness" (Marad al-Mawt). It begins by defining the linguistic, idiomatic, and legal concepts that integrate Family Law and Civil Law, focusing on the nature of terminal illness, its verification criteria, and methods of proof, given its fundamental impact on the validity of legal actions.Such a bequest is built upon essential pillars: the testator (Al-Musi), the beneficiary (Al-Musa lahu), the bequeathed property (Al-Musa bihi), and the legal form (Sigha). It is categorized into five types: obligatory, recommended, prohibited, disliked, and encouraged; the failure of any pillar or the emergence of legal impediments leads to its nullity.Furthermore, real estate bequests are subject to strict regulations aimed at balancing the testator's will with the protection of heirs' rights—most notably, adhering to the "one-third" limit of the estate and ensuring the testator's will is free from coercion. This study highlights specific complexities in the real estate sector regarding the difficulty of proving the state of terminal illness and the legal challenges of transferring ownership. These issues often lead to legal disputes requiring judicial intervention to be resolved in accordance with the principles of Islamic Sharia and applicable statutory laws.en_US
dc.description.abstractيتناول هذا الموضوع الأحكام القانونية والشرعية المنظمة للوصية العقارية الصادرة في حالة مرض الموت، بدءاً من تحديد مفاهيمها اللغوية والاصطلاحية والقانونية التي تجمع بين أحكام قانون الأسرة والقانون المدني، مع التركيز على طبيعة مرض الموت وشروط تحققه ووسائل إثباته نظر ا لتأثيره الجوهري على صحة التصرفات. وتقوم هذه الوصية على أركان أساسية تشمل الموصي والموصى له والموصى به والصيغة، ولها خمس أنواع الواجبة والمستحبة والمحرمة، المكروهة والمندوبة، حيث يؤدي اختلال أي منها أو ظهور موانع شرعية إلى بطلانها. كما تخضع الوصية العقارية لضوابط صارمة تهدف إلى الموازنة بين إ را دة الموصي وحماية حقوق الورثة، وأبرزها التقيد بحدود ثلث التركة وضمان خلو الإ را دة من الإكرا ه. وتبرز الد را سة تعقيدات خاصة في المجال العقاري تتعلق بصعوبة إثبات حالة مرض الموت والإشكالات القانونية لنقل الملكية، مما يفتح الباب أمام منازعات قانونية تستوجب تدخلاً قضائياً للفصل فيها وفقاً لمبادئ الشريعة الإسلامية والنصوص القانونية المعمول بهاen_US
