| Abstract: | تعد تسوية البنايات غير المطابقة لرخص البناء من أبرز الإشكالات التي واجهت السياسة العمرا نية في الجزا ئر، نتيجة انتشار المخالفا ت العمرا نية، وما ترتب عنه من آثار قانونية وعمرا نية متعددة الأبعا د ، ولمعالجة هذه الوضعية، استحدث المشرع الجزا ئري آليات قانونية متنوعة، بداية بالقانون رقم 08 - 1 المتعلق بمطابقة البنايات وإتمام إنجازها، غير أن استمرا ر ظاهرة البنايات غير المطابقة لرخص البناء المسلمة ومحدودية النتائج المحققة بموجب الآليات السابقة دفع المشرع إلى استحدا ث إطار قانوني جدي بموجب المرسوم التنفيذي رقم 22 - 55 المؤرخ في 02 فيفري 2022 ، الصادر تطبيقا للمادة 113 من قانون المالية لسنة 2017 ، وقد حدد المرسوم شروط وإجرا ءات تسوية البنايات المتممة أو التي في طور الإنجاز خلافا لأحكام رخص البناء المسلمة، من خلال منح رخصة بناء معدلة أو شهادة مطابقة على سبيل التسوية، بعد د را سة الملف ومعاينة البناية من طرف الجهات المختصة، مع فرض غرا مة مالية على المخالف وفق الضوابط القانونية المعمول به، كما نظم المرسوم آليات الطعن الإداري والقضائي ضد قرا را ت رفض التسوية، بما يضمن حماية الحقوق والمرا كز القانونية، ويعزز احترا م قواعد التهيئة والتعمير، ويسهم في تحقيق التوازن بين متطلبات الشرعية والتنمية العمرا ن. |
| Description: | The regularization of buildings that do not comply with building permits is considered one of the major challenges facing urban planning policy in Algeria, due to the spread of unauthorized construction and its various legal and urban consequences. To address this situation, the Algerian legislator introduced several legal mechanisms, beginning with Law No. 08-15 concerning the conformity and completion of buildings, and subsequently strengthened this framework through Executive Decree No. 22-55 of February 2, 2022, issued pursuant to Article 113 of the Finance Law of 2017. The decree established the conditions and procedures for the regularization of completed buildings or those under construction that were carried out in violation of the issued building permits, through the granting of an amended building permit or a certificate of conformity by way of regularization, following the examination of the application file and the inspection of the building by the competent authorities, together with the imposition of a financial penalty on the offender in accordance with applicable legal provisions. The decree also regulates administrative and judicial appeals against decisions refusing regularization, thereby protecting rights and legal positions, strengthening compliance with urban planning and development regulations, and contributing to a balance between legality requirements and urban development. |
