Abstract: تهدف هذه المذكرة إلى دراسة مدى ملاءمة الموقف القانوني للمشرع الجزائري من العملات الرقمية، من خلال تحليل النصوص التشريعية النافذة، ولا سيما المادة 117 من قانون المالية لسنة 2018 التي كرّست الحظر الشامل، إضافةً إلى استعراض مستجدات القانون النقدي والمصرفي رقم 23 - 09 ، مع الأخذ بعين الاعتبار التجارب الدولية المقارنة في مجال تنظيم هذه العملات. وقد اعتمدت الدراسة على المنهج الوصفي التحليلي ومنهج المقارنة . وقد أسفرت نتائج الدراسة عن أن نهج الحظر الكامل الذي تبنّاه المشرع الجزائري، رغم مبرراته المتعلقة بحماية السيادة النقدية ومكافحة تبييض الأموال، يظل قاصرًا عن مواكبة التحولات الاقتصادية الرقمية العالمية، لا سيما في ظل انتشار العملات الرقمية فعليًا خارج القنوات الرسمية. وعليه، توصي الدراسة بضرورة الانتقال نحو إطار قانوني تنظيمي شامل يتضمن تعريفًا قانونيًا دقيقًا للعملات الرقمية، ونظامًا للترخيص، وآليات لحماية المستثمرين، مع إنشاء هيئة رقابية متخصصة .
Description: This thesis aims to examine the extent to which Algerian legislation appropriately addresses the phenomenon of digital currencies, through an analysis of the relevant legal provisions, particularly Article 117 of the Finance Law of 2018, which established a comprehensive prohibition, alongside the recent developments introduced by the Monetary and Banking Law No. 23-09, while drawing on comparative international experiences in the regulation of digital assets. The study adopts a descriptive-analytical approach combined with a comparative methodology.The findings reveal that the absolute prohibition approach adopted by the Algerian legislator, despite its justifications relating to monetary sovereignty and anti-money laundering concerns, falls short of keeping pace with global digital economic transformations, especially given the de facto circulation of digital currencies outside official channels. Accordingly, the study recommends transitioning toward a comprehensive regulatory legal framework that encompasses a precise legal definition of digital currencies, a licensing system for service providers, investor protection mechanisms, and the establishment of a specialized supervisory authority.
