| Abstract: | جاءت هذه الد را سة بعنوان "المسؤولية الإدارية للمستشفيات العمومية"، لتحليل الركائز القانونية التي تقوم عليها المسؤولية الإدارية في المجال الطبي، والكشف عن آليات تقدير التعويض وعناصر الضرر في النزا عات الاستشفائية، كذلك تهدف لاستقرا ء وتحليل التوجهات الحديثة لمجلس الدولة الجزا ئري في الفصل في المنازعات الطبية وتوضيح شروط قيام المسؤولية الإدارية وعناصر التعويض عن الضرر . توصلت الد را سة إلى أن المستشفيات العمومية تعد مر ا فق عامة إدارية تخضع أساسا لأحكام القانون العام، غير أن التطبيق العملي كشف عن وجود تباين بين التكييف القانوني الذي أقره المشرع وما استقر عليه اجتهاد مجلس الدولة في بعض قرا را ته، مما أثر على توحيد الأساس القانوني للمسؤولية الإدارية للمستشفيات العمومية، كما كشفت الد را سة عن وجود قصور في الإثبات داخل المنازعات الطبية الإدارية، وهذا نتيجة محدودية وسائل الإثبات واعتماد القاضي الإداري بصورة كبيرة على تقرير الخبير المنفرد، إضافة إلى غياب درجة النقض في هذا النوع من المنازعات، مما قد يؤثر على ضمانات التقاضي وحماية حقوق المتقاضين.وأوصت الد را سة بالتوجه نحو وضع إطار قانوني خاص بالمسؤولية الطبية يوضح حالات المسؤولية بدون خطأ، خاصة المرتبطة بالنشاطات الطبية الخطرة، بما يساهم في تعزيز حماية المتضررين وتخفيف عبء الإثبات عنهم. كما أوصت بالاعتماد على لجان خبرة طبية جماعية ومحايدة لما توفره من موضوعية أكبر في معالجة المنازعات الطبية مقارنة بالخبير الفردي |
| Description: | This study titled "Administrative Liability of Public Hospitals," aims to analyze the legal foundations nderpinning administrative liability in the medical field, and to uncover the mechanisms for assessing compensation and the elements of damage in hospital disputes. Furthermore, it seeks to extrapolate and analyze the modern trends of the Algerian State Council in adjudicating medical disputes, while clarifying the conditions for establishing administrative liability and the components of damage compensation . The study concluded that public ospitals are administrative public utilities subject primarily to the provisions of public law. However, practical application has revealed a discrepancy between the legal characterization established by the legislator and the settled jurisprudence of the State Council in some of its decisions, which has affected the standardization of the legal basis for the administrative liability of public hospitals. The study also revealed deficiencies regarding the burden of proof within administrative medical disputes. This is due to the limited means of proof and the administrative judge's heavy reliance on a single expert's report, in addition to the absence of a cassation level (appeal before the highest court) in this type of dispute, which may affect litigation guarantees and the protection of litigants' rights. The study recommended moving toward establishing a specific legal framework for medical liability that clarifies cases of strict liability (liability without fault), especially those associated with hazardous medical activities, thereby contributing to enhancing the protection of victims and easing their burden of proof. It also recommended relying on collective and neutral medical expertise committees, given the greater objectivity they provide in handling medical disputes compared to a single expert. |
