Abstract

This study addresses a subject of paramount importance in contemporary criminal policy, namely the crime of child abduction under Algerian legislation, given that it ranks among the most serious offences threatening the physical and psychological integrity of the child, as well as public security and social stability.The dissertation aims to analyse this crime through two principal axes, the first is devoted to establishing the conceptual framework of the offence, by delineating its legislative and doctrinal definitions, identifying its distinguishing characteristics, examining the primary causes underlying its proliferation, and deconstructing its constituent legal elements alongside the various forms it assumes in practice. The second axis addresses the legal and procedural framework adopted by the Algerian legislator to combat this phenomenon, through an examination of judicial prosecution mechanisms, investigative and inquiry procedures, as well as an elucidation of the deterrent criminal policy established for its suppression.The study relies upon the descriptive and analytical methodology, deemed most appropriate for examining legal texts, comprehending their substantive content, and evaluating the criminal procedural rules governing the subject matter. This is complemented by a comparative approach, through which certain legal provisions of Algerian legislation are measured against their counterparts in selected foreign legal systems, wherever scientific necessity so demands.In conclusion, the study arrives at a series of findings and recommendations affirming the imperative need to strengthen societal awareness and intensify security and legal efforts in order to safeguard children and ensure their protection
