| Abstract: | تتناول هذه الدرا سة دور الضبطية القضائية كآلية إجرا ئية محورية في مكافحة جرا ئم الفساد، والتي تشكل تهديداً خطيرا للاقتصاد الوطني واستقرا ر المؤسسات. تهدف الد را سة إلى تبيان الصلاحيات الممنوحة لرجال الضبطية القضائية بموجب قانون الإجرا ءات الجزا ئية والتشريعات الخاصة بمكافحة الفساد، والمتمثلة في البحث والتحري عن هذه الجرا ئم، جمع الأدلة، وضبط مرتكبيها لتقديمهم للعدالة . كما تسلط الد را سة الضوء على التحديات والعقبات التي تواجه الضبط القضائي أثناء أداء مهامه، نظرا للمحيط المعقد والسرية التي تتميز بها جرا ئم الفساد )كالرشوة واختلاس المال العام(، وقد خلصت الد را سة إلى جملة من النتائج، أبرزها ضرورة تحديث الآليات القانونية، تعزيز التكوين المتخصص لرجال الضبطية القضائية، وتفعيل التنسيق والتعاون بين مختلف الأجهزة الرقابية والقضائية لضمان نجاعة أكبر في محاصرة الفساد وتجفيف منابعه |
| Description: | This study addresses the role of the judicial police as a pivotal procedural mechanism in combating corruption crimes, which pose a serious threat to the national economy and the stability of institutions. The study aims to clarify the powers granted to judicial police officers under the Code of Criminal Procedure and anti-corruption legislation, which include investigating these crimes, gathering evidence, and apprehending perpetrators to bring them to justice.Furthermore, the study highlights the challenges and obstacles facing the judicial police during the execution of their duties, given the complex environment and secrecy that characterize corruption crimes (such as bribery and embezzlement of public funds). The study concluded with a set of results, most notably the need to modernize legal mechanisms, enhance specialized training for judicial police officers, and activate coordination and cooperation among various supervisory and judicial bodies to ensure greater efficiency in countering corruption and draining its sources. |
