dc.descriptionThis study addresses the issue of personal data privacy in light of the use of Artificial Intelligence (AI) within Algerian legislation. It highlights the extent to which the Algerian legislator has succeeded in establishing protections for personal data privacy against the challenges posed by AI utilization.The study aims to shed light on the various legal guarantees established to protect personal data from the increasing use of AI—particularly through Laws 18-07 and 25-11. It also clarifies the reality of AI in Algeria according to adopted strategies and the readiness index. To achieve this, the study relies on a descriptive approach to define the concepts of privacy, personal data, AI, and its characteristics; a historical approach to trace the evolution of artificial intelligence, and an analytical approach to analyze and extrapolate the relevant legal texts.The study is divided into two chapters. The first chapter covers the conceptual framework of personal data privacy and artificial intelligence, referencing to the definitions of privacy, personal data, AI, and its applications. Meanwhile, the second chapter examines the impacts of AI on personal data privacy by outlining the Algerian AI strategy, key legal texts, and defining national and international cooperation mechanisms. Ultimately, the study reached several conclusions, notably:The Algerian legislator has established a legal framework for personal data protection; however, despite its importance, it still requires further strengthening to keep pace with modern technical developments.Enhancing personal data protection in the era of AI necessitates the creation of national regulatory mechanisms and the activation of national and international cooperation to match continuous technological advancement.en_US
dc.description.abstractتعالج هذه الد را سة موضوع خصوصية البيانات الشخصية في ظل استخدام الذكاء الاصطناعي في التشريع الجزا ئري، وذلك من خلال إبرا ز الى أي مدي وفق المشرع الجزا ئري في تكريس حماية خصوصية البيانات الشخصية من استخدام الذكاء الاصطناعي. وتهدف الد را سة إلى إبرا ز مختلف الضمانات القانونية المقررة لحماية البيانات الشخصية من الاستخدام المتزا يد للذكاء الاصطناعي، لاسيما القانونين 18 - 07 و 25 - 11 ، وتوضيح واقع الذكاء الاصطناعي في الجزا ئر وفق الاسترا تيجيات المتخذة ومؤشر الجاهزية، وقد اعتمدت هذه الد را سة على كل من المنهج الوصفي في تحديد مفهوم الخصوصية والبيانات الشخصية والذكاء الاصطناعي وخصائصه، والمنهج التاريخي في تتبع تطور الذكاء الاصطناعي، وكذلك المنهج التحليلي في تحليل واستقرا ء نصوص القانونية، وقد تم تقسيم الد را سة الى فصلين ، تناول الفصل الأول الإطار المفاهيمى للخصوصية البيانات الشخصية والذكاء الاصطناعي من حيث الإشارة الى مفهوم الخصوصية و البيانات الشخصية و الذكاء الاصطناعي و تطبيقاته، بينما عالج الفصل الثاني تأثيرا ت الذكاء الاصطناعي علي خصوصية البيانات الشخصية من خلال توضيح الاسترا تيجية الجزا ئر في الذكاء الاصطناعي وأهم نصوص القانونية وبالإضافة تحديد آليات التعاون الوطنية والدولية ، وفي النهاية خلصت الد را سة الى نتائج منها: _ أن المشرع الجزائري وضع إطا را قانونياً لحماية البيانات الشخصية، ورغم أهميته إلا أنه لا يزا ل بحاجة الى تعزيزه لمواكبة التطو را ت التقنية الحديثة. _ إن تعزيز حماية البيانات الشخصية في ظل الذكاء الاصطناعي يقتضي إنشاء آليات رقابية وطنية وتفعيل التعاون الوطني والدولي لمواكبة التطور التكنولوجيen_US
