| Abstract: | تناولنا في هذه الد را سة جريمة المتاجرة بالأعضاء البشرية في القانون الجزا ئري، حيث تهدف إلى تحديد إطارها القانوني وبيان أركانهاوخصائصهاوتمييزها عن المفاهيم المشابهة، وتحليل السياسة الجنائية التي اعتمدها المشرع الجزا ئري في مكافحتها من خلال قانون العقوبات، خاصة المواد 303 مكرر 61 إلى 303 مكرر 92 ، إضافة إلى قانون الصحة الذي يكرس مبدأ مجانية التبرع. وقد اعتمدنا في د را ستنا على المنهج الوصفي التحليلي مع الاستعانة بالمنهج المقارن، وتوصلنا إلى أن هذه الجريمة منظمة وعابرة للحدود، تقوم على استغلال الفئات الهشة وتتميز بصعوبة كشفها بسبب سريتها. كما أشارت الد را سة إلى ضرورة تعزيز الرقابة وتشديد العقوبات وتطوير التعاون الدولي |
| Description: | We addressed in this study the crime of human organ trafficking in Algerian legislation, aiming to define its legal framework, clarify its elements and characteristics, and distinguish it from similar concepts. It also analyzes the criminal policy adopted by the Algerian legislator to combat this crime through the Penal Code, particularly Articles 303 bis 16 to 303 bis 29, as well as the Public Health Law, which enshrines the principle of free donation. The study relies on the descriptive-analytical method with the use of a comparative approach, and concludes that this crime is organized and transnational in nature, based on the exploitation of vulnerable groups and difficult to detect due to its secrecy. It further highlights the need to strengthen oversight, impose stricter penalties, and develop international cooperation |
