| Abstract: | تناولت هذه الد را سة موضوع السياسة الجزا ئية الجزا ئرية في ظل التطور التكنولوجي ومدى قدرتها على مواجهة الجرا ئم المستحدثة الناتجة عن التقدم العلمي والتقني، لاسيما الجرا ئم المعلوماتية والجريمة المنظمة العابرة للحدود. وتتمحور إشكالية الد را سة حول مدى والاشكالية الى اي مدى استطاعت السياسة الجزا ئية الجزا ئرية مواكبة التطورا ت السياسة لمواجهة الجرا ئم المستحدثة السياسة الجزا ئية الجزا ئرية في ظل التطور التكنولوجي.وتهدف الد را سة إلى تقييم فعالية السياسة الجزا ئية الجزا ئرية من خلال تحليل النصوص التشريعية والآليات القانونية المعتمدة في مكافحة هذه الجرا ئم، مع إبرا ز أهم التحديات القانونية والإجرا ئية التي تحول دون تحقيق حماية جزا ئية فعالة. كما اعتمدت الد را سة على المنهج الوصفي التحليلي من خلال عر الإطار لمفاهيمي للسياسة الجزا ئية والجرا ئم المستحدثة وتحليل النصوص القانونية ذات الصلة. وتوصلت الد را سة إلى أن المشرّع الجزا ئري بذل جهودًا لمواكبة التطورا ت الإجرا مية الحديثة عبر استحداث نصوص قانونية وآليات إجرا ئية جديدة، غير أن ذلك لا يزا ل يواجه تحديات مرتبطة بسرعة تطورالأساليب الإجرا مية وبعض أوجه القصور التشريعي، مما يستدعي تطويرا مستمراً للمنظومة الجزا ئية |
| Description: | This study examines Algerian criminal policy in light of technological development and its ability to address emerging crimes resulting from scientific and technological progress, particularly cybercrime, and transnational organized crime. The study seeks to answer the following question: To what extent has Algerian criminal policy succeeded in adapting to modern developments in confronting emerging crimes?The research aims to evaluate the effectiveness of the Algerian criminal policy through the analysis of legislative texts and legal mechanisms adopted to combat these crimes. It also identifies the major legal and procedural challenges that hinder effective criminal protection. The study adopts a descriptive and analytical approach by examining the conceptual framework of criminal policy and analyzing relevant legal provisions.The findings reveal that Algeria has made legislative efforts to cope with emerging crimes however, challenges remain due to the rapid evolution of criminal methods and certain legislative shortcomings, requiring continuous legal and institutional development |
