| Abstract: | تناولت هذه الد را سة موضوع الحماية الجنائية للطفل عبر الوسائط الإلكترونية في التشريع الجزا ئري، ضمن بيئة رقمية عالية المخاطر، كالاعتداء على المعطيات الشخصية، وجرا ئم الاستغلال والابتزا ز والتحريض الرقمي. واستهدفت تقييم كفاية الحماية القانونية للطفل داخل البيئة الرقمية ، باستقرا ء قانون العقوبات و قانون حماية الطفل رقم 51 51 ،إضافة إلى قانون الوقاية من جرا ئم تكنولوجيا الإعلام - والإتصال رقم 90 90 ،وقانون حمايةا لمعطيات ذات الطابع الشخصي رقم 90 51 المعدل والمتمم - - بموجب قانون رقم 55 11 . وقد تبنت الد را سة المنهج الوصفي التحليلي ،لاستجلاء أوجه الحماية - - الوقائية والإجرا ئية والردعية، وتقييم مدى فعاليتها.كما خلصت إلى أن المشرع الجزا ئري، رغم إقرا ره لعدة آليات قانونية حمائية، غير أنها لا تزا ل تعاني قصورا تشريعيا، سواء لتشتت النصوص التشريعية وقصور مواكبتها لبعض الجرا ئم المستحدثة، أو لمحدودية الحماية الخاصة بالمعطيات الشخصية ، مما يستوجب تعزيز السياسة الجنائية وتوفير بيئة رقمية آمنة تكفل حماية الطفل ، دون المساس بحقوقه أو تقييدها |
| Description: | This study addressed the criminal protection of children through electronic media in Algerian legislation, within a high-risk digital environment characterized by attacks on personal data, crimes of exploitation, blackmail, and digital incitement. It aimed to assess the adequacy of the legal protection afforded to children in the digital space by examining the Penal Code, the Child Protection Law No. 15-12, the Law on the Prevention of Information and Communication Technology Crimes No. 09-04, and the Law on the Protection of Personal Data No. 18-07, as amended and supplemented by Law No. 25-11. The study adopted a descriptive- analytical approach in order to elucidate the preventive, procedural, and deterrent dimensions of protection and to evaluate their effectiveness. It concluded that, despite the Algerian legislator’s adoption of several protective legal mechanisms, they continue to suffer from legislative shortcomings, whether due to the dispersion of legislative texts and their inability to keep pace with certain emerging crimes, or to the limited protection specifically afforded to personal data. This necessitates the strengthening of criminal policy and the provision of a safe digital environment that ensures the protection of the child without violating or restricting their rights. |
