Abstract

This study examines the new provisions introduced by Law No. 25/14 concerning the establishment of the principle of double-degree investigation in criminal matters, as one of the most important procedural guarantees aimed at strengthening the protection of the parties’ rights during the judicial investigation stage, within the framework of the recent reforms affecting the Code of Criminal Procedure. The study aimed to highlight the amendments introduced by the legislator through expanding the scope of orders subject to appeal before the Indictment Chamber, as well as extending the category of parties entitled to exercise such appeals. The study also sought to analyze the developments related to the guarantees of double-degree investigation, particularly those concerning the reinforcement of defense rights and the protection of individual liberty, while examining the impact of these reforms on the effectiveness of criminal justice and the quality of procedures, as well as their contribution to achieving a balance between procedural efficiency and fair trial guarantees. The study concluded that the establishment of the principle of double-degree investigation represents an important step toward strengthening judicial oversight over investigative actions; however, the effectiveness of this system remains dependent on its proper implementation and the development of the legal and regulatory mechanisms governing it
