Abstract:	لقد نتج عن الثورة الرقمية والطفرة التكنولوجية المعاصرة ظهور نمط إجرا مي مستحدث يعرف ب "الجريمة المعلوماتية"؛ وهي الجريمة التي فرضت واقعاً قانونياً وإجرا ئياً جديداً يختلف جذرياً عن الأنماط التقليدية للجريمة. وقد جاءت هذه الد را سة المعنونة "آليات البحث والتحري عن الجرا ئم المعلوماتية" لتسليط الضوء على الإطار المفاهيمي والمؤسساتي والإجرا ئي الذي تبناه المشرع الجزا ئري لمواجهة هذا التحدي السيبرا ني المتسارع. فمن خلال هذه الد ا رسة نجد أن الجريمة المعلوماتية بطبيعتها اللامادية والعابرة للحدود فرضت على المشرع الجزا ئري تبني مقاربة مرنة تجمع بين آليات الوقاية )الهيئة الوطنية وسلطة حماية المعطيات( وآليات الردع )الضبطية القضائية المتخصصة آوليات البحث والتحري (، مع الاعتماد على وسائل تقنية مستحدثة كبرا مج التتبع لإثبات الدليل الرقمي؛ إلا أن فعالية هذه المنظومة تظل مرهونة بمواجهة صعوبات إخفاء الأدلة ونقص التكوين الفني والتشريع القانوني الخاص بهذا النوع من الجرا ئم، مما يستدعي حتمياً تكثيف التأهيل التقني للمحققين وتدويل التعاون القضائي لمواكبة الطفرة الرقمية
Description:	The digital revolution and the contemporary technological boom have given rise to a new criminal pattern known as "cybercrime." This crime has imposed a new legal and procedural reality that differs radically from traditional forms of crime. This study, entitled "Mechanisms for Investigating and Combating Cybercrime," aims to shed light on the conceptual, institutional, and procedural framework adopted by the Algerian legislator to confront this rapidly evolving cyber challenge.The study reveals that the intangible and transnational nature of cybercrime has compelled the Algerian legislator to adopt a flexible approach that combines preventative mechanisms (the National Authority and the Data Protection Authority) with deterrent mechanisms (specialized judicial police and investigative mechanisms), while relying on modern technological means such as tracking software to establish digital evidence. However, the effectiveness of this system remains contingent on overcoming the difficulties of concealing evidence and the lack of technical training and specific legislation for this type of crime. This necessitates, inevitably, intensifying the technical training of investigators and internationalizing judicial cooperation to keep pace with the digital revolution.
