dc.description	This study addresses the topic of penal policy as a mechanism to combat illegal immigration, considering it one of the serious criminal phenomena that has spread widely in recent years due to the threat it poses to the social, economic, and political security and stability of states, in addition to its association with organized crime and migrant smuggling networks. This study aims to highlight the effectiveness of penal policy in curbing the phenomenon of illegal immigration through the legal, preventive, and deterrent mechanisms adopted nationally and internationally.The study is divided into two chapters. The first chapter addresses the conceptual and legislative framework of penal policy as a mechanism to combat illegal immigration, discussing the concepts of penal policy and illegal immigration, outlining their causes and effects, and presenting the various legal texts and legislations regulating the fight against this phenomenon.The second chapter is dedicated to studying the policy pursued at both national and international levels to combat illegal immigration, highlighting the efforts of the Algerian legislator and the adopted deterrent and preventive mechanisms, alongside the role of nternational conventions and security and judicial cooperation between states in confronting migrant smuggling networks and limiting the spread of this phenomenon.The study concludes that the success of penal policy in combating illegal immigration cannot be achieved through legal deterrence alone; rather, it requires the adoption of a comprehensive approach based on promoting economic and social development, raising awareness, and intensifying international cooperation, while respecting human rights and protecting migrants from various forms of exploitatio	en_US
dc.description.abstract	تتناول هذه الد را سة موضوع السياسة العقابية كآلية لمكافحة الهجرة غير الشرعية، باعتبارها من الظواهر الإجرا مية الخطيرة التي شهدت انتشا را واسعا في السنوات الأخيرة، لما تسببه من تهديد للأمن والاستقرا ر الاجتماعي والاقتصادي والسياسي للدول، إضافة إلى ارتباطها بالجريمة المنظمة وشبكات تهريب المهاجرين. وتهدف هذه الد را سة إلى إبرا ز مدى فعالية السياسة العقابية في الحد من ظاهرة الهجرة غير الشرعية من خلال الآلياتالقانونيةوالوقائية والردعية المعتمدة وطنيا ودوليا . وقد تم تقسيم الد را سة إلى فصلين، تناول الفصل الأول الإطار المفاهيمي والتشريعي للسياسة العقابية كآلية لمكافحة الهجرة غير الشرعية، حيث تم التطرق إلى مفهوم السياسة العقابية والهجرة غير الشرعية، وبيان أسبابها وآثارها، إضافة إلى عرض مختلف النصوص القانونية والتشريعات المنظمة لمكافحة هذه الظاهرة . أما الفصل الثاني فقد خُصص لد را سة السياسة المتبعة على المستويين الوطني والدولي لمكافحة الهجرة غير الشرعية، من خلال إبرا ز جهود المشأرع الجزا ئري والآليات الردعية والوقائية المعتمدة، إلى جانب دور الاتفاقيات الدولية والتعاون الأمني والقضائي بين الدول في التصدي لشبكات تهريب المهاجرين والحد من انتشار الظاهرة . وقد خلصت الد را سة إلى أن نجاح السياسة العقابية في مكافحة الهجرة غير الشرعية لا يتحقق بالردع القانوني فقط، وإنما يتطلب اعتماد مقاربة شاملة تقوم على تعزيز التنمية الاقتصادية والاجتماعية، ونشر الوعي، وتكثيف التعاون الدولي، مع احترا م حقوق الإنسان وحماية المهاجرين من مختلف أشكال الاستغلال	en_US
