Abstract

The cadastral survey is considered a fundamental legal mechanism for the protection of real estate ownership and the establishment of the land registration system. It was established pursuant to Ordinance No. 75/74 and regulated by Executive Decrees No. 75/62 and 75/63. The legislator also created administrative bodies responsible for its management and organization, namely the National Agency for Land Surveying and the Land Survey Commission, in addition to other bodies involved in the cadastral survey process such as the Directorate of State Property and the Land Registry Office.Despite the legislative and practical efforts made to regulate this system, the practical reality continues to generate numerous real estate disputes. These disputes are divided into those arising from the material operations of the cadastral survey, such as measurement errors and area calculation mistakes, as well as disputes related to the registration of property under an unknown account and, finally, disputes concerning tribal lands.
