| Abstract: | يعد موضوع المسؤولية المدنية للمحامي في المنازعات العقارية في القانون الجزا ئري ، من الموضوعات القانونية المهمة نظرا للدور الهام الذي يؤديه المحامي في حماية الحقوق العقارية والدفاع عنها أمام الجهات القضائية ،وتتمثل إشكالية الد را سة في مدى كفاية القواعد القانونية المنظمة للمسؤولية المدنية للمحامي في القانون الجزا ئري، لمساءلته عن الأخطاء المهنية التي قد يرتكبها أثناء مباشرته للمنازعات العقارية، من خلال تحديد الإطار القانوني للمسؤولية المدنية للمحامي في القانون الجزا ئري ، والأسس التي تقوم عليها مع إبرا ز خصوصية تطبيقها في المجال العقاري والأثار المترتبة عن قيامها وتحقيقا لذلك ، تم الإعتماد على المنهج الوصفي التحليلي، من خلال تحليل النصوص التشريعية المنظمة لمهنة المحاماة والقواعد العامة للمسؤولية المدنية والإجتهادات القانونية ذات الصلة . فالمسؤولية المدنية للمحامي تقوم على توافر أركانها القانونية المتمثلة في الخطأ والضرر وعلاقة السببية، وأن خصوصية المنازعات العقارية تقتضي من المحامي بذل عناية مهنية مشددة تتناسب مع أهمية الحقوق والمرا كز القانونية محل النزا ع . كما تبين أن تحقيق التوازن بين حماية حقوق الموكل وضمان استقلالية المحامي في أداء مهامه يقتضي استحداث أحكام قانونية خاصة ، ووضع معايير موضوعية واضحة ، تضبط المسؤولية المدنية للمحامي في المنازعات العقارية ، وتحدد نطاق الخطأ المهني الجسيم بما يضمن عدم المساس بحق الدفاع أو تقييده |
| Description: | The subject of the civil liability of lawyers in real estate disputes under Algerian law is considered one of the prominent legal topics due to the significant role that lawyers play in protecting and defending real estate rights before judicial authorities. The problem of the study lies in the adequacy of the legal rules regulating the civil liability of lawyers under Algerian law to hold them accountable for professional errors they may commit while handling real estate disputes.This is achieved by defining the legal framework of the lawyer's civil liability under Algerian law and its underlying foundations, while highlighting the specificity of its application in the real estate field and the resulting consequences. To achieve this purpose, the descriptive-analytical approach was adopted by analyzing the legislative texts regulating the legal profession, the general rules of civil liability, and relevant legal precedents.The study indicates that a lawyer's civil liability is established upon the fulfillment of its legal elements, namely: fault, damage, and causal relationship. Furthermore, the specific nature of real estate disputes requires the lawyer to exercise strict professional care commensurate with the importance of the rights and legal statuses subject to the dispute.The study also reveals that achieving a balance between protecting the client's rights and ensuring the lawyer's independence in performing their duties necessitates the introduction of special legal provisions and the establishment of clear, objective criteria. These measures should regulate the lawyer's civil liability in real estate disputes and define the scope of gross professional error in a manner that ensures the right of defense is neither compromised nor restricted. |
