| Abstract: | اعتمد المشرع الجزا ئري على عقد الامتياز كآلية وحيدة لمنح العقار الاقتصادي، وكرّس جملة من القوانين التي تنظمه باعتباره أحد الاشكالات التي تواجه المستثمر خلال مساره في تنفيذ المشاريع الاستثمارية، نظرا لتطلبه لجملة من الشروط التي ترشحه لاستقبال المشاريع، وكذا تطلبه لتهيئة وتسيير وتجهيز ليكون مؤهلا لاحتضان المشاريع الاستثمارية، هذا ما يؤكد أهمية د را سة هذا الموضوع حيث أنه يعتبر حجر الأساس في عملية تفعيل الاستثمار وتحسين المناخ الاستثماري والتنموي، في حين تهدف الد را سة لإبرا ز فاعلية النصوص القانونية المستحدثة على تدفق الاستثمار والنهوض بالمجال، وفي سياق ما سبق ذكره جاءت هذه الد را سة لإبراز دور عقد امتياز العقار الاقتصادي في تفعيل الاستثمار بالاعتماد على الوصف والتحليل، ومعالجة الموضوع والوقوف على أهم المستجدات المتعلقة بالعقار الاقتصادي وعملية منحه لكونه ينعكس بشكل مباشر على فعالية الاستثمار |
| Description: | The Economic Real Estate Concession Contract for Activating Investment In Algeria. The Algerian legislator has adopted the concession contract as the sole mechanism for granting real, and has enshrined a set of laws regulating it. This is considered one of the challenges facing investors during the implementation of investment projects, given the requirement for a set of conditions that qualify the land to host projects, as well as the need for preparation, management, and equipping it to be eligible to accommodate investment projects. This nderscores the importance of studying this topic, as it is considered the cornerstone in the process of activating investment and improving the investment and development climate. The study aims to highlight the ffectiveness of the newly introduced legal texts on the flow of investments and the advancement of the sector. In this context, this study highlights the role of the economic real estate concession contract in activating by relying on description and analysis, addressing the topic, and examining the most important developments related to economic real estate and the process of granting it, as it directly impacts the effectiveness of nvestment. |
