Abstract: شهد العالم في السنوات الأخيرة تطو را تكنولوجياً متسارعاً أدى إلى ظهور الأعمال التجارية الإلكترونية كصورة حديثة لممارسة النشاط التجاري، حيث أصبحت مختلف العمليات التجارية تتم عبر الوسائط الإلكترونية وشبكة الإنترنت مما ساهم في تسهيل المبادلات التجارية وتوسيع نطاقها. وأمام هذا التطور، سعى المشرع الجزا ئري إلى وضع إطار قانوني ينظم الأعمال التجارية الإلكترونية من خلال مجموعة من النصوص القانونية، بهدف ضمان أمن الأعمال الإلكترونية وحماية أطرا فها . وتهدف هذه الد را سة إلى بيان مختلف الضوابط القانونية المنظمة لممارسة الأعمال التجارية الإلكترونية في القانون الجزا ئري، من خلال د را سة متطلبات ممارستها، وكيفية إبرا مها واثباتها، إضافة إلى النطق لإلتزا مات أطرا فها والجزا ءات المترتبة عن الإخلال بتنفيذها. وتخلص الد را سة إلى أن المشرع الجزا ئري حاول من خلال النصوص القانونية المنظمة للتجارة الإلكترونية وضع إطار قانوني يضمن تنظيم الأعمال التجارية الإلكترونية وتحقيق الحماية القانونية لأطرا فها، غير أن التطور المستمر للتكنولوجيا يفرض ضرورة مواصلة تطوير المنظومة القانونية بما يواكب مستجدات البيئة الرقمية.
Description: In recent years, rapid technological advancement has led to the rise of electronic commercial transactions as a modern form of trade conducted via the internet, which has expanded and facilitated commercial exchanges. In response, the Algerian legislator has established a legal framework regulating electronic commerce to ensure the security of transactions and protect the parties involved.This study examines the legal rules governing electronic commercial activities in Algeria, focusing on the conditions for practicing e-commerce, the formation and proof of electronic contracts, the obligations of the parties, and the penalties for non-performance. The study concludes that, although Algerian legislation provides a structured legal framework for electronic commerce and the protection of its actors, continuous technological evolution requires further legal adaptation and improvement to keep pace with digital developments.
