| Abstract: | تتناول هذه الد را سة موضوع الوساطة التجارية كآلية بديلة لتسوية منازعا ت الأعمال، من خلال بيان مفهومها باعتبارها وسيلة قانونية حديثة تهدف إلى تيسير المعاملا ت التجارية عبر تدخل وسيط مستقل ومحايد يعمل على تقريب وجها ت النظر بين الأطرا ف المتنازعة للوصول إلى حل ودي للنزا ع. كما تسلط الد را سة الضوء على أهم المزا يا التي تحققها الوساطة التجارية، والمتمثلة في تقليل التكاليف، والسرعة في تسوية النازعات،والمرونة، والمحافظة على العلاقا ت التجارية بين الأطرا ف. ويتطرق البحث كذلك إلى أبرز التحديا ت التي قد تواجه تطبيق الوساطة التجارية ، مثل ضعف الثقة بين الخصوم، واحتمال تعار ض المصالح، إضافة إلى بعض الإشكالا ت المرتبطة بدور الوسيط وحدو د تدخله. كما يستعر ض الإطا ر القانوني المنظم للوساطة التجارية، من خلال بيان حقوق وواجبا ت الوسيط والأطرا ف المتنازعة، بما يبرز أهمية الوساطة التجارية في تعزيز فعالية العدالة وتحقي ق الاستقرا ر في المعاملا ت التجارية والاقتصادية |
| Description: | Commercial Mediation for the settlement of Business Disputes This study addresses commercial mediation as an alternative mechanism for resolving business disputes by clarifying its concept as a modern legal method aimed at facilitating commercial transactions through the intervention of an independent and impartial mediator whose role is to bring the disputing parties’ viewpoints closer and reach an amicable settlement. The study also highlights the main advantages achieved by commercial mediation, namely reducing costs, ensuring speedy dispute resolution, flexibility, and preserving commercial relationships between the parties. Furthermore, the research examines the main challenges that may hinder the application of commercial mediation, such as the lack of trust between litigants, potential conflicts of interest, and certain issues related to the mediator’s role and the limits of their intervention. In addition, the study reviews the legal framework governing commercial mediation by outlining the rights and obligations of both the mediator and the disputing parties, thereby contributing to enhancing judicial efficiency, achieving stability in commercial transactions, encouraging investment, and promoting a culture of amicable settlement of commercial and economic disputes. |
