| Abstract: | تناولنا في هذه الدرا سة موضوع الحماية القانونية للملكية الصناعية لتشجيع الاستثمار الأجنبي، من خلال إبرا ز أهمية توفير نظام قانوني فعال يحمي مختلف عناصر الملكية الصناعية كبرا ءات الاخترا ع والعلامات التجارية والرسوم والنماذج الصناعية، لما لذلك من أثر مباشر في تعزيز ثقة المستثمر الأجنبي وجذب رؤوس الأموال الأجنبية. وقد تطرقنا إلى مفهوم الملكية الصناعية والاستثمار الأجنبي وأهم الضمانات القانونية المقررة له، كما تناولنا مختلف آليات الحماية المتمثلة في الحماية المدنية والجزا ئية والإدارية لمواجهة جرا ئم التقليد والمنافسة غير المشروعة. وأبرزنا فيها دور الاتفاقيات الدولية خاصة اتفاقية باريس لحماية الملكية الصناعية واتفاقية تريبس في تنظيم القواعد التي تحميها. وخلصت الد را سة إلى أن فعالية حماية الملكية الصناعية تساهم بشكل كبير في تحسين مناخ الاستثمار وتشجيع نقل التكنولوجيا والخبرا ت الفنية وتحقيق التنمية الاقتصادية، مما يستوجب تحديث الأنظمة القانونية وتطويرها، وتفعيل آليات الرقابة والجهات القضائية المختصة لضمان حماية فعالة ومستقرة لهذه الحقوق |
| Description: | This study addressed the topic of the legal protection of industrial property as a means of encouraging foreign investment, by highlighting the importance of establishing an effective legal system that protects the various elements of industrial property, such as patents, trademarks, industrial designs, and models, due to their direct impact on enhancing foreign investors’ confidence and attracting foreign capital .The study also examined the concept of industrial property and foreign investment, as well as the most important legal guarantees provided for it. In addition, it discussed the various protection mechanisms represented in civil, criminal, and dministrative protection to combat counterfeiting crimes and unfair competition. The study further emphasized the role of international agreements, particularly the Paris Convention for the Protection of Industrial Property and the TRIPS Agreement, in regulating the rules governing such protection.The study concluded that the effectiveness of industrial property protection contributes significantly to improving the investment climate, encouraging the transfer of technology and technical expertise, and achieving economic development. This therefore requires the modernization and development of legal systems, as well as the strengthening of monitoring mechanisms and specialized judicial bodies to ensure effective and stable protection of these rights. |
