Abstract: تتمحور د را ستنا حول الإطار المفاهيمي و الإجرا ئي لحماية المستهلك من الغش التجاري ضمن القانون رقم 03_09 المتعلق بحماية المستهلك وقمع الغش المعدل والمتمم، فبالنسبة للإطار المفاهيمي فإن الغش كل سلوك أو ممارسة يقوم بها المتدخل بهدف غش المستهلك سواء من خلال تغيير طبيعة المنتج أو السلعة أو أحد مكوناتها وحتى الغش في صلاحياتها، وتقوم جريمة الغش التجاري على ركنين وهما الركن المادي الذي يشمل الفعل المتمثل في الغش والركن المعنوي الذي يقوم على القصد الجنائي والعلم بالغش. إضافة إلى محل الجريمة الذي يكون عادة سلعة أو خدمة، وكذلك أطرا ف الغش التجاري المتمثلين في المتدخل المتسبب في الغش والمستهلك ضحية الغش التجاري ، مع التمييز بين مصطلح الغش التجاري والتدليس والإشهار الكاذب والتضليلي كونهم مصطلحات متشابهة مع الغش التجاري . أما لإطار الإجرا ئي لحماية المستهلك من الغش التجاري كان بالتطرق إلى دور الجهات الإدارية المختصة على غرا ر مصالح قمع الغش التي تمتلك صلاحيات معاينة المخالفات، تحرير المحاضر وحجز السلع غير المطابقة، كما يبرر دور القضاء في متابعة مرتكبي جرا ئم الغش التجاري من خلال تحريك الدعوى العمومية وتوقيع العقوبات المناسبة، وإجرا ءات التقاضي التي يمكن أن يلجأ إليها المستهلك للمطالبة بحقه سواء أمام القضاء المدني للحصول على التعويض أو أمام القضاء الجزا ئي لمعاقبة الجاني . إضافة إلى ذلك توضيح دور الجمعيات في حماية المستهلك من خلال التوعية والتبليغ عن المخالفات مع التأكيد على أهمية التنسيق بين مختلف الجهات لضمان فعالية الحماية القانونية والحد من انتشار الغش التجاري
Description: Our study revolves around the conceptual and procedural framework for consumer protection against commercial fraud under Law No. 09-03 relating to consumer protection and fraud repression, as amended and supplemented. Concerning the conceptual framework, commercial fraud refers to any behavior or practice carried out by the intervening party with the intention of deceiving the consumer, whether through altering the nature of the product or commodity, one of its components, or even its validity and characteristics. The crime of commercial fraud is based on two main elements: the material element, which consists of the fraudulent act itself, and the moral element, which is based on criminal intent and awareness of the fraud. In addition, the subject matter of the crime is generally a product or service, while the parties involved in commercial fraud are represented by the intervening party responsible for the fraud and the consumer as the victim of such fraudulent practices. The study also distinguishes between the concept of commercial fraud and other related concepts such as deceit, false advertising, and misleading advertising, given their similarity to commercial fraud. As for the procedural framework for consumer protection against commercial fraud, the study addressed the role of the competent administrative authorities, particularly fraud control services, which possess powers to detect violations, draft official reports, and seize non-compliant goods. It also highlighted the role of the judiciary in prosecuting perpetrators of commercial fraud crimes through initiating public action and imposing appropriate penalties. Furthermore, the study examined the legal procedures that consumers may resort to in order to claim their rights, whether before civil courts to obtain compensation or before criminal courts to punish the offender. In addition, the role of consumer protection associations was clarified through awareness-raising and reporting violations, while emphasizing the importance of coordination among the various authorities to ensure the effectiveness of legal protection and reduce the spread of commercial fraud.
