Abstract: تهدف هذه الد را سة إلى معرفة الحماية القانونية للمستهلك في عقود التجارة الإلكترونية ، من خلال إبرا ز خصوصية المستهلك الإلكتروني والمخاطر التي يتعرض لها في البيئة الرقمية، والإشكالية الأساسية المتعلقة بمدى فعالية القواعد القانونية في توفير حماية حقيقية له أثناء إبرا م وتنفيذ العقد الإلكتروني. كما سعت الد را سة إلى تحليل وسائل الحماية المدنية والجزا ئية المقررة للمستهلك الإلكتروني، وتقييم مدى كفايتها في مواجهة التطورا ت التقنية الحديثة. وتم الإعتماد على المنهج الوصفي التحليلي من خلال عرض المفاهيم القانونية وتحليل النصوص التشريعية المنظمة للتجارة الإلكترونية وحماية المستهلك. وقد خلصت الد را سة إلى أن المشرع الجزا ئري أقر مجموعة من الآليات القانونية المهمة لحماية المستهلك الإلكتروني، غير أن فعاليتها ما زا لت تواجه عدة صعوبات مرتبطة بالتطور التقني وضعف التطبيق العملي. وبناءا على هذه النتائج، توصي الد را سة بضرورة تحديث النصوص القانونية، وتعزيز الرقابة الإلكترونية، ونشر الوعي القانوني لدى المستهلكين، وتطوير آليات الحماية الرقمية بما يواكب تطور التجارة الإلكترونية
Description: This study aims to clarify Legal protection for Consumers in E-Commerce Contracts by highlighting the particular nature of the electronic consumer and the risks faced within the digital environment, as well as the main issue related to the effectiveness of legal rules in providing real protection during the conclusion and execution of electronic contracts. The study also seeks to analyze the civil and criminal protection mechanisms established for the electronic consumer and to assess their adequacy in confronting modern technological developments. The study relied on the descriptive-analytical approach through presenting legal concepts and analyzing legislative texts regulating e-commerce and consumer protection. The study concluded that the Algerian legislator has established a set of important legal mechanisms to protect the electronic consumer; however, their effectiveness still faces several difficulties related to technological development and weak practical implementation. Based on these findings, the study recommends updating legal texts, strengthening electronic supervision, spreading legal awareness among consumers, and developing digital protection mechanisms in line with the evolution of e-commerce.
