Abstract: شهد العالم المعاصر تحولاً جذرياً نحو الرقمنة الشاملة، وهو ما انعكس إيجاباً على كفاءة المعاملات المالية، ولكنه أدى في المقابل إلى ظهور أنماط مستحدثة من الجريمة المنظمة، وفي مقدمتها جريمة تبييض الأموال في البيئة الرقمية، حيث تُعرف هذه الجريمة بأنها سلوك إجرا مي تقني يعتمد على استغلال التطور التكنولوجي والتدفقات المالية الافترا ضية لإخفاء المصدر غير المشروع للأموال المستمدة من أنشطة محظورة قانوناً، وإعادة دمجها في الاقتصاد الرسمي لتبدو كأنها أرباح شرعية، وتتميز هذه الظاهرة الإجرا مية باعتمادها على آليات تكنولوجية معقدة تتجاوز الأساليب التقليدية؛ حيث تمر بثلاث مرا حل متداخلة ومطورة رقمياً تبدأ با لإيداع عبر منصات التداول والمحافظ الإلكترونية، ثم التمويه والتغطية من خلال شبكة معقدة من التحويلات الخاطفة واستخدام أدوات إخفاء الهوية، وصولا إلى مرحلة الدمج النهائي في النظام المالي التقليدي أو الرقمي، وتتعدد الوسائل المستخدمة في هذا النطاق، بدءاً من العملات المشفرة ذات الخصوصية العالية مرو را بالرموز غير القابلة للاستبدال ) Nfts ) وصولاً إلى منصات الألعاب الإلكترونية وبنوك الظ ل الرقمية وهي أدوات تمنح الجناة ميزة السرية المطلقة والسرعة الفائقة في التنفيذ، بناءً على ذلك تواجه لمنظومة القانونية والأمنية الدولية تحديات جسيمة لمكافحة هذه الجريمة، تتبلور في الطابع العابر للحدود الوطنية للبيئة الرقمية، وغياب الهوية الحقيقية للمتعاملين، فضلاً عن وجود فجوات تشريعية بين الدول، الأمر الذي يستلزم تحديث الاستر ا تيجيات الوقائية والعقابية من خلال تفعيل تقنيات الذكاء الاصطناعي في رصد المعاملات المشبوهة، وتشديد تدابير الامتثال والتحقق من الهوية الرقمية ) KYC (، مع التأكيد على حتمية تعزيز التعاون الد ولي القضائي والأمني لمواجهة هذا التهديد المتنامي للاقتصاد العالمي
Description: The contemporary world has witnessed a radical shift toward comprehensive digitization, which has enhanced financial transaction efficiency but conversely led to the emergence of novel patterns of organized crime, cyber-enabled money laundering being chief among them. This crime is defined as a sophisticated technological misconduct that exploits advancements in financial technology and virtual financial flows to conceal the illicit origin of funds derived from illegal activities, ultimately reintegrating them into the formal economy as legitimate wealth. This criminal phenomenon is characterized by its reliance on intricate technical mechanisms that transcend traditional methods, operating through three interrelated and digitally enhanced stages: placement via trading platforms and electronic wallets; layering through a complex web of rapid transactions and anonymity-enhancing tools; and finally,integration into the mainstream or digital financial systems.The methods employed in this domain vary widely, ranging from privacy-centric cryptocurrencies and Non-Fungible Tokens (NFTs) to online gaming platforms and digital shadow banks tools that grant perpetrators total anonymity and hyper-speed execution. Consequently ,global legal and security frameworks face formidable challenges in combating this crime , primarily due to the inherently borderless nature of the digital environment, the lack of real identity verification, and regulatory disparities across jurisdictions. Therefore, mitigating this growing threat to the global economy necessitates updating preventive and punitive strategies by deploying artificial intelligence to detect suspicious transactions, tightening Know Your Customer (KYC) digital compliance measures, and reinforcing international judicial and security cooperation
