| Abstract: | تعتبر الد را سة القانونية لموضوع صلاحيات الوالي في مجال حماية البيئة أمرا ضروريا، فتظهر مكانة البيئة لدى المشرع من خلال تخصيصه للقانون رقم 03 / 10 المتعلق بحماية البيئة في إطار التنمية المستدامة، حيث أولى المشرع أهمية كبيرة لحمايتها مع إلزا م السلطات العمومية بالتدخل للحفاظ عليها وتعد من أهم القضايا المعاصرة نظرا لارتباطها بصحة الإنسان والتنمية المستدامة، كما يلعب الوالي في هذا الإطار بصفته ممثل للدولة على مستوى الولاية د و را محوريا وفعالا في الارتقاء بالبيئة، حيث يمارس عدة صلاحيات إدارية وتنظيمية إضافة إلى تنسيقه مع المصالح المختصة، كما يضطلع بدور وقائي من خلال إعداد مخططات لمواجهة أي ضرر والعمل على تقليل المخاطر البيئية قبل وقوعها؛ بالإضافة أنه يساهم في نشر الوعي البيئي، ومن جهة أخرى يساهم المجلس الشعبي الولائي باعتباره هيئة منتخبة في دعم الجهود البيئية على المستوى المحلي حيث يصادق على المشاريع المتعلقة بحماية البيئة وتحسين إطار المعيشة؛ كما يعمل على اقترا ح حلول للمشاكل البيئية التي تعاني منها الولاية ومرا قبة تنفيذ السياسات العمومية في هذا المجال. وعليه فإن حماية البيئة على المستوى المحلي تقوم على تكاملالأدوار بين الوالي باعتباره سلطة تنفيذية والمجلس الولائي كهيئة تداولية مما يساهم في تحقيق تنمية مستدامة ومتوازنة. |
| Description: | The legal study on the powers of the wali in the field of environmental protection is considered a significant matter. It reveals the importance that the legislator places on environmental protection through Law No. 03/10 regarding environmental protection within the framework of sustainable development. The legislator gives interest to its protection, and this by assigning public authorities to intervene for its preservation. It is considered as one of the recent crucial issues due to its direct link to human health and sustainable development. As a representative of the state at the provincial level, the Wali plays a central and effective role in improving the environment. He exercises several administrative and regulatory powers and coordinates with competent departments. He also plays a preventive role by preparing plans to face any damage and working to reduce environmental risks before their occurrence. Furthermore, he contributes to Assembly as an elected body, contributes to supporting environmental efforts At the local level by approving projects related to nvironmental protection and Improving the living environment, it also works on proposing solutions to environmental problems faced by the province and monitoring the implementation of public policies in this field. Accordingly, environmental protection at the local level is based on the integration of roles between the Wali, as an executive authority, and the Provincial Council, as a deliberative body, which contributes to achieving a sustainable and balanced environment. |
