| Abstract: | يعد التصريح بالممتلكات مسألة ذات وجهين، فمن ناحية يسهم في نزا هة الأشخاص المكلفين بخدمة عمومية، ومن ناحية أخرى يثير الشك حول نزا هة كل مسؤول يمتنع عن تقديم هذا التصريح. إذ يعاقب كل موظف عمومي يخل بواجب التصريح، سواء بالامتناع عن تقديمه، أو بتقديم تصريح غير صحيح أو ناقص، كما يعاقب أيضا في حال تسجيل زيادة كبيرة في ذمته المالية مقارنة بمداخيله المشروعة دون القدرة على تبريرها. وفي هذه الخالات يحال المخالفون إلى النيابة العامة لتحريك الدعوى العمومية عند الاقتضاء. وقد أسند المشرع الجزا ئري مهمة تلقي تصريحات بالممتلكات الخاصة بذوي المناصب القيادية إلى رئيس، المحكمة العليا، في حين يقدم باقي الموظفين العموميين تصريحاتهم أمام الهيئة الوطنية للوقاية من الفساد ومكافحته، وهي سلطة إدارية مستقلة ويقوم الموظف العمومي بالتصريح بممتلكاته العقارية والمنقولة، إما مباشرة أو عن طريق السلطة السلمية أو الوصائية، وذلك عند بداية ونهاية خدمته أوعهدته الانتخابية، وكذلك عند حدوث زيادة معتبرة في ذمته المالية، وفق الآجال والكيفيات المحددة قانونا |
| Description: | The declaration of assets is considered a mechanism with two main dimensions. On the one hand, it contributes to enhancing the integrity of public officials and promoting transparency. On the other hand, it raises doubts about the integrity of any official who fails to submit such a declaration. Therefore, any public employee who breaches this obligation is subject to sanctions, whether by refusing to submit the declaration, providing an inaccurate or incomplete statement, or in cases where a significant increase in personal assets is observed in comparison to lawful income without proper justification. In such cases, the offenders are referred to the public prosecutor to initiate legal proceedings where appropriate. The Algerian legislator has entrusted the responsibility of receiving asset declarations from senior officials to the President of the Supreme Court, while other public employees are required to submit their declarations to the National Authority for the Prevention and Fight against Corruption, which is an independent administrative body. The declaration includes both movable and immovable assets and is submitted either directly or through hierarchical or supervisory authorities. It must be filed at the beginning and end of service or electoral mandate, as well as in the event of a significant increase in assets, in accordance with legally established deadlines and procedures. |
