Abstract

The subject of this study centers on the mechanisms of environmental protection from againt waste in Algerian legislation,it higlights the various preventive and remedial mechanisms established by the Algerian legislator to protect the environment from the hazards of waste. This is achieved by examining the legal regulatory framework and demonstrating theeffectiveness of these mechanisms in mitigating pollution through preventive measures befor damage occurs, alongside deterrent measures that impose administrative and penal sanctions to safeguard the environment from any harm resulting from its abusive exploitation. The study relies on the descriptive approach by outlining the classification of waste according to its degree of hazardousness and management methods, as well as the analytical approach by analyzing the legal texts and executive degree regulating waste management, alongside the bidiesresponsible for its management and oversight.The study relies on a descriptive approach by clarifying waste classification according to its severity, and an analytical approach by analyzing the legal texts and decrees regulating waste management, as well as the bodies responsible for management and oversight.The data collection in this study was based on legal texts, decrees, books, and journals, in addition to theses (dissertations) and reports on waste classification, as well as some procedures taken in this field related to waste.Among the results reached through this study:* Obliging the producer to bear the responsibility of paying compensation for environmental damage.* Adopting the “Eco-design” method with the aim of reducing the consumption of natural resources and minimizing waste roduction. * Imposing administrative sanctions and criminal penalties to protect the environment against perpetrators of crimes.
