| Abstract: | يتمثَّل الاختصاص القضائي لمجلس الدولة، في ظل أحكام القانون 22 - 13 المعدل والمتمم لقانون الإج ا رءات المدنية والإدارية 08 - 09 في النظر في الطعون الإدارية المرفوعة أمامه، والمتمثلة أساسا في الطعون بالاستئناف ضدَّ القرا را ت الصادرة عن المحكمة الإدارية للاستئناف للجزا ئر العاصمة، وكذا استئناف الأوامر الاستعجالية في الحالات المقررة قانونا، إلى جانب الطعون بالنقض الموجهة ضدَّ القرا را ت النهائية الصادرة عن الجهات القضائية الإدارية، فضلا عن الطعون بالنقض المخوَّلة له بموجب نصوص قانونية خاصة، لاسيما المتعلقة بقرا را ت مجلس المحاسبة والمجلس الأعلى للقضاء.كما ينعقد لمجلس الدولة اختصاص الفصل في مسائل قضائية أخرى، تتمثل في تسوية تنازع الاختصاص بين الجهات القضائية الإدارية، والفصل في بعض المنازعات المسندة إليه بموجب نصوص خاصة، ومن بينها القضايا المتعلقة بالأحزا ب السياسية والسلطات الإدارية المستقلة. وتؤكد هذه الاختصاصات المكانة المحورية لمجلس الدولة في حماية المشروعية، وضمان حسن سير القضاء الإداري داخل المنظومة القضائية الجزا ئرية |
| Description: | The judicial jurisdiction of the Conseil d’état, under the provisions of law no.22- 13 amending and supplementing law no.08- 09 on Civil and Administrative Procedures, consists in examining administrative appeals brought before it, mainly appeals against decisions issued by the Administrative Court of Appeal of Algiers, as well as appeals against urgent orders in cases provided by law, in addition to cassation appeals directed against final decisions rendered by administrative judicial bodies, together with cassation appeals assigned to it under special legal provisions, particularly those relating to decisions of the Court of Accounts and the High judicial Council.The Council of State is also vested with jurisdiction over other judicial matters, namely resolving conflicts of jurisdiction between administrative judicial bodies and deciding certain disputes entrusted to it by special legal provisions, including cases related to political parties and independent administrative authorities .These powers confirm the central position of the council of State in protecting legality and ensuring the proper functioning of administrative justice within the Algerian judicial system. |
